IPA Fundamental Rights Website Online!

The website of the Technical Assistance for Strengthening Fundamental Rights Sector Coordination Project is now online. You can follow all the developments and news about the Fundamental Rights field of the Instrument for Pre-Accession Assistance (IPA) and our project at ipatemelhaklar.ab.gov.tr

The website will provide an effective communication platform to convey our stakeholders and target groups up-to-date information on thematic areas of our Project, main reference documents, annual reports, training materials, and news from the project.

Moreover, via our website, you can access developments regarding other projects financed in the IPA Fundamental Rights Field as well as the online resource hub, which is underway. The online resource hub will include various publications related to fundamental rights, compiled from national and international sources.
Fundamental Rights Trainings Started!
Training on Fundamental Rights from the EU and EU Accession Perspective
 
We kicked-off institutional capacity building activities of  our project with the  Training on Fundamental Rights from the EU and EU Accession Perspective

During the training held in Ankara on 28-29 September, the representatives of relevant public institutions were informed on the structure of the EU, its functioning, sources of law as well as the progress and role of fundamental rights in the EU. Moreover, the participants discussed the main subjects related to the Copenhagen Political Criteria and the Chapter 23, Judiciary and Fundamental Rights. The training was delivered by Prof. Dr. Sanem Baykal, Capacity Building Key Expert of the Project.
Project Design and Project Cycle Management Training

The Project Design and Project Cycle Management Training was held on 18-19 October in Ankara with the participation of the relevant public institutions. 

The training, which serves as a general introduction to project design and execution, covered information on the main institutions, concepts and processes of IPA as well as project stages from idea development to approval. The training was interactively delivered through workshops by Dr. Petek Kovancı Shehrin, Senior Expert of the Project.
Thematic Trainings

The first four trainings out of ten themes in fundamental rights were completed!

These trainings will strengthen capacities of the staff of relevant public institutions regarding the EU acquis in various fundamental rights areas.
Training on  Women’s Rights
 
During the first stage of the training delivered by Assoc. Prof. Dr. İdil Aybars on 2-3 November 2022, the representatives of public institutions working in the field of women's rights, were informed on the EU acquis and good practices as well as the European Commission's new legislative proposals. 

In addition, EU’s relevant strategies and policy documents as well as the regulations of international organizations such as the Council of Europe and the United Nations were covered.

In the second stage of the Women's Rights Thematic Training held on 1-2 December 2022, the participants discussed the project ideas in line with the relevant EU acquis and in particular strategies and policy documents. A workshop on project design was held to write down the project ideas of the participants into the project fiche template.



Training on Freedom of Expression and Right to Information

In the training held on 17-18 November 2022 for public institutions working related to freedom of expression and right to information, Assoc. Prof. Dr. Ulaş Karan covered the relevant EU Acquis, while Elena Chernievska and Antonina Cherevko from the office of the OSCE Representative on Freedom of the Media discussed media freedom and hate speech from the OSCE perspective.

Furthermore, trainers covered relevant EU strategies and policy documents, the European Court of Human Rights (ECtHR) case-law as well as the activities and documents of international organizations such as the Council of Europe and the United Nations in the area of freedom of expression, media freedom and right to information. Besides the EU acquis the practices of the EU member states were also discussed.

As part of the training, Elena Chernievska and Antonina Cherevko made an online presentation to the participants on the mandate of the OSCE and the scope of media freedom and hate speech.

The second phase of Thematic Training on Freedom of Expression and Right to Information was held on 13-14 December 2022. During the training, the participants worked on developing ideas for IPA projects while gaining experience on project design and writing methods.
Training on Children’s Rights
 
In the training held in Ankara for public institutions working on children's rights on 22-23 November 2022, Senior Expert Adem Arkadaş-Thibert discussed the relevant EU acquis and the good practices in the EU member states.

Also EU strategies and policy documents in the field of children’s rights as well as on the activities of international organizations including the Council of Europe and the United Nations were covered by the trainer.
Training on Anti-Discrimination

During the training delivered on 29-30 November 2022 by Prof. Dr. İlke Göçmen for relevant public institutions, the participants discussed the extensive EU acquis in the field of anti-discrimination, the good practices of the EU member states and the principle of equality within the  Union’s various policies.

During the training, the participants were informed of the case-law of the ECtHR and the Court of  Justice of the EU (CJEU), EU’s relevant strategies and policy documents as well as the activities and reference documents of international organizations, in particular the Council of Europe and the United Nations.
What Did We Do So Far in the Project?
Fundamental Rights Study Visit: We met with the EU Fundamental Rights Agency, OSCE and the Austrian Authorities
 
Within the scope of our project, we conducted the first study visit to Vienna, Austria between 7-10 November 2022 and exchanged information on good practices related to human rights in order to improve the capacities of relevant institutions. During the visit, we had meetings with the EU Fundamental Rights Agency (FRA), the Organization for Security and Co-operation in Europe (OSCE) Representative on Freedom of the Media, the Division of Women and Equality of Austria and the Austrian Ombudsman.

We discussed the potential cooperation areas in the field of fundamental rights with the institutions visited.
We Held the 2nd  Steering Committee Meeting of the Technical Assistance for Strengthening Fundamental Rights Sector Coordination Project
 
We organized the 2nd Steering Committee Meeting of our Project on 27 September 2022. During the meeting, we informed relevant public institutions and non-governmental organizations as well as the Delegation of the EU to Türkiye (EUD) and Central Finance and Contracts Unit (CFCU) on the activities completed within the first six months of the project. Moreover, we exchanged views with the participants on the second six-month implementation period
Fundamental Rights Sector Coordination Platform
Guidelines is Ready

The Guidelines covering the structure and functioning of the Fundamental Rights Sector Coordination Platform was prepared in English and Turkish by taking into account of opinions of our stakeholders.
Evaluation of IPA II Fundamental Rights Projects Started

We started the evaluation of four projects in the field of IPA Fundamental Rights. Firstly, we completed the meetings with the beneficiaries and relevant institutions for the evaluation of the "Implementing Gender-Responsive Planning and Budgeting in Türkiye" Project. The overall evaluation activity will shed light on the upcoming programming processes and support the monitoring and evaluation activities while strengthening the institutional capacity of the Directorate for EU Affairs.

News from the IPA Fundamental Rights
Human Rights and Equality Institution of Türkiye Accredited by the Global Alliance of National Human Rights Institutions

The Human Rights and Equality Institution of Türkiye was accredited with B status by the Global Alliance of National Human Rights Institutions.

Establishing Strong Monitoring, Evaluation and Coordination Mechanism for National Roma Strategy (ROMSID) Project

Within the scope of the ROMSID project, IT-based monitoring and evaluation system was developed.

This system will provide an effective monitoring and evaluation of the National Strategy Document and Action Plans for Roma People via data received from all relevant public institutions. 

In the awareness-raising event held in Izmir for three days within the project, non-governmental organizations shared their opinions on the draft Strategy Document for Roma People.

Technical Assistance Project for the Empowerment of the Role of Ombudsman Institution in Protection and Promotion of Human Rights (Ombudsman Project)

Within the Ombudsman Project, regional workshops were held in order to raise awareness of the public with regard to the Ombudsman Institution. The beneficiary continued the study visits to EU member states to examine good practices and exchange information. 

Moreover, the International Knowledge and Experience Sharing Conference on Migration and Human Rights was held in Istanbul on 9-11 November 2022.

The Project on Strengthening Democratic Culture in Basic Education

The closing ceremony of the project was held on 21 September 2022 in Ankara. The whole school model concept, which was started to be implemented in 110 pilot schools in 10 provinces, is extended to 373 schools. 

The beneficiary of the project  organized the Strategic Planning Meeting on 16 November 2022 in Kızılcahamam/Ankara. During the meeting, the stakeholders discussed policy recommendations for dissemination of good practices and elimination of the challenges encountered during pilot implementation.

Project on Supporting the Effective Implementation of Turkish Constitutional Court Judgements in the Field of Human Rights

Within the project, study visits were organized to Strasbourg/France in June and July. Moreover, an international conference was held with more than 200 participants on the 10th anniversary of the individual application to the Constitutional Court. 

In addition, regional meetings and roundtables were held within the capacity-building activities for the judges and prosecutors.

Technical Assistance Project for the Supporting Children’s Rights in Türkiye

The first major awareness-raising event of the Özne Çocuk Project was held in Çanakkale on 12 June 2022 on the World Day Against Child Labour.

Implementing Gender-Responsive Planning and Budgeting in Türkiye Project

Within the project, workshops were held to analyze the programs and activities implemented by the pilot public institutions from the perspective of equality between women and men. 

In this scope, various budget programs of the Ministry of Family and Social Services, the Ministry of Youth and Sports, the Directorate for EU Affairs and the Turkish Employment Agency are being analyzed.

Current Developments on Fundamental Rights in the EU
EU Regulation Introducing New Rules on Digital Services Published

The "Regulation on a Single Market for Digital Services", shortly known as the "Digital Services Act", was published in the EU Official Journal on 27 October 2022. The implementation of the Regulation by EU member states will start on 17 February 2024.

The Regulation introduces rules to prevent illegal content in the digital environment and to protect the fundamental rights of internet users.

Thus, online platforms across the EU are envisaged to take an active role in preventing the dissemination of illegal and harmful content via enhanced transparency and accountability.

The Regulation also sets forth certain restrictions on use of children's personal data and personal data that can be considered sensitive in advertising, while prohibits misleading interfaces and applications.

EU-Wide Helpline Number for Victims of Violence Against Women

The EU established the helpline 116 016 for the victims of violence against women.

Women who are victims of violence will be able to call the same number across the EU to get advice and support. The deadline for EU member states to reserve the common EU number to connect to national helplines is end of April 2023.

2022 Evaluation of Code of Conduct on Countering Illegal Hate Speech Online Realised

2022 Evaluation Report shows that all IT companies improved frequency and quality of feedback to users flagging hateful content while most of them had a slowdown on removal and review times for hate speech notifications. Anti-gypsyism (16.8%), xenophobia (16.3%), antisemitism (9.9%) and anti-Muslim (8.7%) are among the most commonly reported grounds of hate speech.

European Commission Announced Proposal for a “European Media Freedom Act”

The European Commission published a Proposal for a “European Media Freedom Act” on 16 September 2022. The proposal includes holistic provisions for the protection of media freedom, pluralism, transparency and integrity.

Once the proposal is in force, it will be the first regulation exclusively focused on media freedom at the EU level.

The Proposal for the Regulation envisages establishing a new independent “European Board for Media Services”, comprised of national media authorities, and to cooperate with candidate and potential candidate countries.

European Commission Proposed a Regulation on Prohibiting Products Made with Forced Labour on the Union Market

In line with the United Nations Sustainable Development Goal No. 8.7 to eradicate forced labour, the European Commission released a proposal for a regulation to prohibit the placing and making available on the EU market and export from the EU of products made with forced labour. 

According to the proposal, national authorities will be authorized to withdraw products made with forced labour from the EU market following an investigation. 

In this framework, EU customs authorities will be authorized for detection and stopping of products made with forced labour at EU borders.

European Commission Proposed Artificial Intelligence Liability Directive

Proposal for Artificial Intelligence Liability Directive, which was released on 28 September 2022 by the European Commission, introduces new rules to mitigate the risks generated by specific uses of AI and to ensure respect of fundamental rights and security. 

The proposal envisages new provisions regarding the compensation of damages that may be caused by human rights violations due to the use of artificial intelligence and the elimination of specific difficulties of proof.

EU Plans to Amend the Regulation on the Statute and Funding of European Political Parties and European Political Foundations

Amendment to the Regulation No 1141/2014 on the statute and funding of European political parties and European political foundations is now on the agenda of the EU.

Proposal for Regulation foresees measures such as increasing the contribution to parties and foundations from the EU budget, limiting foreign intervention by putting a cap on financial contributions outside the EU, and strengthening gender equality within political parties. The proposal aims to have a more transparent and participatory election period for European Parliament  in 2024. 

The Regulation is planned to be amended by 2023 fall.

European Parliament Adopted Resolution on the Situation of Fundamental Rights in the EU in 2020 and 2021

The European Parliament adopted a Resolution dated 15 September 2022 on the situation of fundamental rights in the EU in 2020 and 2021. The resolution evaluates the implementation of fundamental rights in the EU and calls on EU member states to better protect freedom, equality and the rule of law.

The Resolution underlines that the restrictive measures taken in 2020 and 2021 within the scope of the COVID-19 pandemic have negative effects on fundamental rights and caused an increase in racist incidents in particular affecting vulnerable groups while addresses the violations of fundamental rights against migrants, refugees and asylum seekers.

In the Resolution, the European Parliament calls on EU institutions and member states to combat the roots of structural racism, stating that the fight against this problem should be implemented together with measures in criminal justice, education, housing, health care and employment.

As IPA Fundamental Rights family, we will continue working together for strengthening and promotion of fundamental rights in 2023, the 100th anniversary of the Republic of Türkiye.
