Brief Description of the Project and Main Objectives
The objective of the project is to strengthen the effective implementation of the decisions of the Constitutional Court in the field of human rights and to raise the awareness on the case-law of the Constitutional Court and the individual complaints mechanism.
Achieved Results / Expected Outputs
- Establishing a mechanism for monitoring the execution of the decisions of the Constitutional Court in accordance with the EU standards and practices and strengthening the monitoring of the stakeholder platform
- Examining the systemic shortcomings of human rights law identified in the context of the case-law of the Constitutional Court
- Informing judges, prosecutors, relevant public employees and lawyers about the case-law of the European Court of Human Rights and the Constitutional Court and enabling judges, prosecutors, relevant public employees and lawyers to implement these decisions in similar cases
- Transferring EU experiences in the field of fundamental rights, strengthening the cooperation of Turkish courts and relevant stakeholders with the European institutions/courts as well as the institutions / courts of the EU Member States institutions / courts, and thus, paving the way for necessary changes in line with the EU standards
- Raising the awareness of the public and public institutions on the role of the decisions of the Constitutional Court in the protection of human rights
Under the project, in addition to the effective implementation of the violation decisions awarded by the Constitutional Court, activities are carried out to prevent the occurrence of new violations in the light of the violation decisions and to reduce the number of individual applications to the Constitutional Court. To this end, regional workshops and roundtables are organized with the participation of judges and prosecutors.
